The Office of Public Safety & Inspection Enforces License Requirements to Operate Hoisting Machinery

Please be advised that, as the winter weather leads to snow accumulations across Massachusetts, the Office of Public Safety and Inspections ('OPSI') will continue to enforce the licensing requirements to operate Hoisting Machinery, in accordance with M.G.L. c. 146 §53 and 520 CMR 6.00. Anyone operating Hoisting Machinery, as defined in 520 CMR 6.01(2), with or without Manufacturer Approved Attachments to remove snow must hold a valid Hoisting license with the appropriate restriction. Unlicensed operation of Hoisting Machinery is a violation of the licensing requirements and is subject to civil fines from the OPSI.

Please note that the Hoisting license requirement only applies to machinery within the scope of the Hoisting Machinery definition in 520 CMR 6.01(2), standard motor vehicles with snow removal attachments are not generally considered Hoisting Machinery and thus do not require licensure.

If you have any questions, you can contact Cesar I. Lastra, Technical Code Coordinator, at cesar.lastra@mass.gov.
